13. Payment Policy

Definitions:

User: Person or business paying for a service via GoodPoker.in

User Account: shall mean a bank account or credit/ prepaid/ cash card account of the Buyer with the Issuing Institution.

Card Network/Card Brand: Networks that power credit card transactions. These include Visa, MasterCard, American Express and Discover.

The User will bear and be responsible and liable for the payment of all relevant taxes in relation to the Payments made under this Agreement.

User will receive the amount (minus our charges) and net of taxes in their bank account within T+3 business days where T is defined as the date of intimation of the completion of the transaction.

14. TDS

Section 194B of Income Tax Act states the following, “The person responsible for paying to any person any income by way of winnings from lottery or crossword puzzle or card game and other game of any sort in an amount exceeding ten thousand rupees shall at the time of payment thereof, deduct income tax thereon at the rates in force”.

On prize money of more than 10000 INR, Tax would be deducted at source (“TDS”) at the rate specified as per the Indian Income Tax Act 1961 (as amended to date) or as per any other law in force at the time being. The winner will receive the prize money only after the above-mentioned deduction.

TDS is applicable at the time of payment, which is when a Player’s ‘Winnings’ are calculated. According to the Indian Tax laws, TDS on winnings from card games is on a gross basis, so players cannot deduct their losses and expenses to determine taxable income.

Thus, Winnings more than 10,000 INR are subject to TDS of 30% (exclusive of surcharge and cess) and payment to the player will be after deduction of such taxes. No TDS or Tax is applicable if the Winning amount is less than or equal to 10,000 INR at the time of payment.

The User hereby agrees and acknowledges that the winnings from Games, tournaments or through any other services as provided by the Website shall be allowed to be withdrawn only after deduction of applicable TDS. The User also agrees to furnish a scanned copy of his/her PAN (Permanent Account Number) duly issued to him / her by the Income Tax Department, Government of India, to deduct TDS as per the rules and regulations of the government of India. The User also agrees and acknowledges that deduction of TDS by the Website does not absolve the User from his or her overall liability to pay all applicable tax on his/her winnings from all games / tournaments played on the Website during the course of the year. The User expressly acknowledges that it remains his/her liability to calculate the total tax due to the relevant tax authorities at the end of the year and to pay any balance tax over and above any TDS that would have been paid on the User’s behalf. A Game of cards for a user ends once he/she withdraws chips from the User Balance and TDS, if applicable as per the regulations, will be deducted on the winnings at that time.

15. Protection

The services are intended to be used by only a person of 18 years and above. If GoodPoker.in notices non complaining with any of their policies by any user, it has all the authority to delete the account of any such user. All balances in such account will be null and void with immediate effect and it will be at the sole discretion of GoodPoker.in

16. Severability

Each paragraph of this privacy policy shall be and remain separate from and independent of and severable from all and any other paragraphs herein except where otherwise expressly indicated or indicated by the context of the agreement. The decision or declaration that one or more of the paragraphs are null and void shall have no effect on the remaining paragraphs of this privacy policy.
